Gymcore Ltd – Terms and Conditions of Sale

This page (together with any documents referred to in it) sets out the terms and conditions on which we supply any of the products (“Products”) listed on our website (www.gymcore.co.uk) to you.

Please read these terms carefully before placing any order with us. By ordering any of our Products, you agree to be bound by these terms and conditions. We recommend that you print a copy for your records.

1. INFORMATION ABOUT US

2. SERVICE AVAILABILITY

2.1. We accept orders from customers worldwide, including the European Economic Area (“EEA”), the USA, Asia, and other regions where delivery is possible.

3. YOUR STATUS

By placing an order through our site, you confirm that:

3.1.1. You are legally capable of entering into binding contracts.
3.1.2. You are at least 18 years old.
3.1.3. You are resident in one of the countries we service.

4. HOW THE CONTRACT IS FORMED

4.1. After placing an order, you will receive an email acknowledging receipt. This acknowledgement does not mean your order has been accepted.
4.2. Your order is an offer to purchase Products from us. All orders are subject to acceptance and availability.
4.3. Acceptance is confirmed when we send you an email confirming dispatch of your Products (the “Dispatch Confirmation”). A binding contract (“Contract”) is formed only when we send the Dispatch Confirmation.
4.4. The Contract relates only to the Products listed in the Dispatch Confirmation.
4.5. We reserve the right to refuse any order.
4.6. When placing an order, you warrant that the details you provide are accurate, that you are the authorised user of the payment method used, and that sufficient funds are available.

5. CONSUMER RIGHTS

5.1. If you are contracting as a consumer, you may cancel a Contract within seven days of receiving the Products. You will receive a full refund in accordance with our Returns Policy.

6. AVAILABILITY AND DELIVERY

6.1. Your order will be fulfilled by the delivery date specified in the Dispatch Confirmation or, if no date is given, within 14 days of that confirmation, unless prevented by exceptional circumstances.

7. PRICE AND PAYMENT

7.1. Prices shown on the website include UK VAT but exclude delivery costs, which are displayed separately at checkout.
7.2. Payment must be made by the methods shown on our website and is not complete until cleared funds are received.
7.3. Prices are subject to change, but changes will not affect confirmed orders.
7.4. Our site contains many Products, and errors may occur. We verify prices during dispatch:

• If a Product’s correct price is lower than shown, you will be charged the lower price.

• If a Product’s correct price is higher, we will either contact you for confirmation or reject your order.
  7.5. We are not obliged to supply Products at an incorrect price if the error is obvious and could reasonably have been recognised by you as such.
  7.6. Payment is accepted by VISA, VISA Debit, MasterCard, Maestro, Solo, and Electron.
  7.7. Prices of foreign products and services may fluctuate.
  7.8. Only one promotional code may be used per order.

8. REFUNDS POLICY

8.1. For details of refunds, please refer to our Returns Policy.

9. OUR LIABILITY

9.1. If we fail to deliver, or if Products are defective, damaged, or incorrect, our liability is limited to one of the following at our discretion:

• Supplying the missing or correct Products.

• Replacing defective or damaged Products.

• Refunding the amount paid.

9.2. We will not be liable for indirect or consequential losses, including lost revenue, profits, contracts, goodwill, or data.
9.3. Our total liability in connection with a Contract will not exceed the amount paid for the Products concerned.
9.4. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under law.
9.5. Your statutory rights are not affected.

10. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in connection with the Products belong to Gymcore Ltd.

11. WRITTEN COMMUNICATIONS

By using our site, you accept that communication with us will be primarily electronic. We may contact you by email or post notices on our website. You agree to this method of communication.

12. NOTICES

12.1. All notices to us must be sent to info@gymcore.co.uk.
12.2. We may give notice to you via the email or postal address you provide.
12.3. Notices are deemed received:

• Immediately when posted on our site.

• 24 hours after an email is sent.

• 3 days after posting by mail.

13. TRANSFER OF RIGHTS AND OBLIGATIONS

13.1. Contracts are binding on you, us, and our successors.
13.2. You may not transfer your rights without our prior written consent.
13.3. We may transfer our rights or obligations under a Contract at any time.

14. EVENTS OUTSIDE OUR CONTROL

14.1. We are not liable for failure or delay caused by events outside our reasonable control (“Force Majeure Event”).
14.2. Such events include, but are not limited to: strikes, civil unrest, terrorism, war, fire, flood, natural disasters, transport disruption, telecommunications failure, or government action.
14.3. Our obligations are suspended during such events, and we will seek to resume performance as soon as possible.

15. WAIVER

15.1. Failure to enforce any right does not constitute a waiver.
15.2. Waivers of breaches must be in writing and do not apply to future breaches.

16. SEVERABILITY

16.1. If any clause is found to be invalid or unenforceable, the remaining provisions will remain valid.
16.2. Where possible, invalid clauses will be interpreted to reflect the original intent.

17. ENTIRE AGREEMENT

17.1. These terms, together with referenced documents, form the entire agreement between us.
17.2. Neither party has relied on representations not set out in these terms.
17.3. No remedy is available for pre-contractual statements unless made fraudulently.

18. VARIATIONS

18.1. We may revise these terms to reflect changes in law, technology, market conditions, or our business practices.
18.2. You will be subject to the terms in force at the time of your order, unless changes are required by law or we notify you before sending the Dispatch Confirmation.

19. LAW AND JURISDICTION

These terms and conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
